Yet another McDonald's lawsuit!

Cell phone lost in Fayetteville restaurant leads to suit over nude photos

Phillip and Tina Sherman of Bella Vista filed a lawsuit against McDonald's Corporation; Mathews Management Company, which owns the McDonald's franchise on Sixth Street in Fayetteville; and Aaron Brummley, a manager of the restaurant. The suit seeks more than $3 million in damages after nude photographs of Tina Sherman were posted on a Web site.

The suit claims Phillip Sherman lost his phone at the restaurant on July 5. The phone contained nude photographs his wife sent him.

Though employees promised to secure the phone until Phillip Sherman returned, his wife began receiving text messages from it, the suit claims. The photographs later made their way to a Web site.

Brummley refused to comment, referring the matter to company officials. McDonald's officials and franchise owners did not return messages seeking comment.
I have seen a lot of ridiculous lawsuits, especially against McD's, but this one is easily the most hysterical and bizarre I've heard filed against them.

Here's an idea: Don't take nude pictures with your cell phone, then you don't have to worry about them being posted on the net!

That topic came up on the morning radio show before how they got sent in the wrong direction.

Every decade there is a new bizarre McDonald's lawsuit.

She's probably not pretty.

Isn't this just like the Southwest girl as well? Use internet fame?

It's like walking through a landmine when searching because of possible applications down links. There is just a black and white laying down one with an imposed McDonald's arch. McDelicious.

Because of the simple fact that everyone knows McDonalds brand, people assume they can get millions of dollars from suing them.

Work? For a living? Why? When I can sue!

Fayetteville - I've stayed there twice on the way to Florida by car so I was pulling for them that it was not NC as well. I'll give NC some credit.

If some lady is hot enough to send nudes, let her.

It's the husband's fault for leaving a phone full of nudes at McDonalds. I woulda never let that ish out of my sight till I got home and destroyed that chick.

I'm going to take a guess and assume that the biggest search on Google over the next few days will be something along the lines of "McDonalds lost cellphone nude"

It's sad that I know people that have those kinda pics on their cell phones.

But, if someone leaves a phone, you shouldn't go through the pictures.

Going through to contacts in the phone list to call and say I found your cell phone is one thing....but those employees had no right to go through the images and anything else in that phone.

True, they shouldn't have.

Still the fault lies firstly with the owners of the cell phone. I'm sorry, but you need some more common sense than to walk around with nude pictures on your cell phone.

I knew a guy (who is divorced now) who took nude pics of his wife, then for revenge posted them on the internet because she cheated on him.

People just need to use some common sense and keep some things private.

I completely agree with Katie. People should not have any busniess going through your photos. Contatcs are ok cause i have done it before when people left phones on rides at Carowinds & Disney. Most of the time the person who left it will call it a few min later anyway.

I somewhat agree that you should not have nude photos on your phone but it's really not that big of a deal. Things on your phone are supposed to be private so i see nothing wrong with nude photos on a cell phone.

To be honest i almost don't believe this story. I think the woman wanted attention & money so she left her phone and had someone she knew pick it up and post the pictures.

People at McDonalds can't even get orders right so what makes you think they know how to upload pictures to the net.

According to that third paragraph in the quote, she sent him the photos of herself. And Ryan, her name is out, so they'll just Google her name.

While the employees shouldn't have been going through her phone's pictures, once you have stuff like that on your phone its the risk you take.

Its like MySpace photos and stuff...If you leave it out there for the public to see, eventually you're gonna be asking for it!

But I think McDonald's will settle to shut her up, they don't want to go to court for this.

^ If they can sue, then the people with child porn on their computers that take them to Geek Squad and get caught should be able to sue as well.

I am kind of on the fence with this one. I agree they had no right to go through the cell phone and they had absolutely NO right to post them on the net. If it were me I would feel violated and highly pissed.

On the other hand I would never send nude photos via my cell to begin with, or anything sexual that could possibly be published on the net without my permission.

In other words, don't send/take any nude photos unless you are aware of the possible consequences!
