The expected lawsuit will charge Playland and Westchester County with wrongful death, carelessness and negligence. The family claims the boy should not have been allowed to ride alone, and that the ride should have had better supervision and seatbelts.

An investigation conducted by the state declared the county was not negligent. The investigation also concluded that the boy was not seated properly, but it is unknown why he left the boat.
