The Court of Appeals ruled that lawyers for the plantiffs in the case wrongfully used insinuations of racial discrimination in the lawsuit. In 1999, a family was at the Largo, Maryland amusement park when they were told their child was too short to ride the Typhoon SeaCoaster. The family refused to leave their boat, and a scuffle ensued.

The case has been sent back to a lower court for a new trial.
