Finance: Ohio court rules against Six FlagsBy Aaron |
Jan. 10th, 2005 -- Last month, the Ohio Supreme Court ruled that amusement park rides are not tax free structures but "business fixtures" and can be taxed. The ruling could cause problems for Six Flags, which did not pay property taxes on rides at what is now Geauga Lake. According to the Geauga County auditor, Six Flags owes about $2.5 million in property taxes from 1999 to 2003. The company said that the court's decision was too broad and has filed a motion for reconsideration. Under Ohio law, tax-free structures are defined as permanent constructions that are not buildings, but contribute to the enjoyment or the use of the land the construction is on.
