News: Family planning to sue Playland

Sep. 13th, 2005 -- The family of Jon Kely Cassara, a 7-year-old boy who died Aug. 3 after becoming trapped under the conveyer belt of Playland's Ye Old Mill, has announced intentions to sue the park and the county.

The expected lawsuit will charge Playland and Westchester County with wrongful death, carelessness and negligence. The family claims the boy should not have been allowed to ride alone, and that the ride should have had better supervision and seatbelts.

An investigation conducted by the state declared the county was not negligent. The investigation also concluded that the boy was not seated properly, but it is unknown why he left the boat.

I suppose we should have expected a lawsuit to come of this, they seem to accompany most amusement park deaths these days. However, does anyone find it a little weird that the family is charging the boy shouldn't of been allowed to ride alone? Shouldn't it be the family's responsibility?

Got to protect the family is a natural concept. Some big mouthed people sueing is just the American way. What a nation we are apart of.

Why are people so sue-happy? The investigation concluded that the child was not riding properly and that negligence was not the cause. That should be the final word. These people probably just want money and refuse to accept responsibility.

If this case does go to the courts and they do win, will they donate the money like they said?

Well if the park and the county were not responsible then that should come out in court. That of course is just theory.

Aaron I agree 100%.

People have this whole "it's not my fault" mentality these days.

Seems to me that the parents should have taken a look at the ride before putting him on there by himself.

It's very sad, but I find that the parents are at fault as much if not more than the park.

It's like these deaths of mentality handicapped persons. Why put someone on a ride where they can't control themselves?

Myself I probably would never sue a park unless it was a case like the one in TN where the park had tampered with the safety system and the lady fell out.

Let's just hope no rides or parks have to close. Six Flags Astroworld is enough for one season.
