That is just sad :-(. I feel bad for the family. But, over a tree....I don't know what I would do. I am pretty speechless at this point.

Yea, does that say anything? Over a Tree. Seems the family seeks publicity more than anything... , they also should have kept a better eye on thier child.. I mean your walking along and a tree suddenly falls on your kid. Sounds like Ebaumsworld needs a phone call LMAO!.

Seems kind of weird to me...a tree branch randomly falls on a child that happens to be walking under it.
I'd think that maybe he was hanging on it or something.

I'm sorry but that kind of seems rediculous to me.
The park shouldn't be held responsible, the tree company should.
The park doesn't know anything about trees, it would be up the tree service to tell them if something was wrong and tha the tree needed to be cut down.
This just seems like a freak accident and I don't see a need to sue the park.

However, because the park owns the tree, and the property that it was growing on, they're responsible for it. If you had a tree on your home property that fell over and hit a neighbor's house, you're the one that's going to have to pay for it- regardless of whether it's a natural occurance, a tree trimming company did it, or whatnot.
It's certainly a sad occurance. I hope that they can come to some sort of agreement quickly. I have a feeling that none of them wanted it to come to this- hence why it's taken over a year and there have been ongoing negotiations.
