News: Land owner disputes ownership of Beech Bend Rd

Oct. 28th, 2006 -- On Tuesday a group of Bowling Green, KY business leaders met  hoping to end a battle over a small stretch of Beech Bend Road that leads into the park’s property.

The land dispute has been ongoing for more than three years and has already cost the city of Bowling Green millions of dollars in tourism revenue.

The issue at hand is the last 700 feet of Beech Bend Road that Former Court of Appeals Judge Matt Baker says is his property and is private land.  Dallas Jones, owner of Beech Bend however says that the road is public.

This August the Court of Appeals ruled that Beech Bend Road was in fact property of the county, but Baker is appealing the decision.

The park and drag strip have already lost business due to the dispute.  In September the National Hot Rod Association announced it would no longer hold its annual reunion at the complex because of the ongoing dispute.

Hopefully this issue will be solved soon before it cost Beech Bend and the town more.

Umm, so where is the problem?? Even if it is the guy's road, what's the problem? Does he suddenly not want the 700ft of road to be driven on? IS he in need of it being his own random stretch of road that noone else can drive on? This is so stupid! Sounds like a real jerk to me. The nerve of some people is sickening. Killing off tourism, and costing your city millions of dollars over something so petty. Only in America people. Sheesh.

^^ Zingo if the road is in fact on private property then he is within his rights to not allow anyone to drive on it.

Doesn't mean that I would like it, but there are always people like this in life. You just have to deal with it an move on.

The guy must not like drag cars or something. lol

I am pretty confident that this unfortunate matter will get resolved rather soon, now that its made public. Hopefully both parties will be able to come to an agreement, so that no further business from Beach Bend is harmed. I plan on going to this park next year, and it seems to me to be good park with tons of potential. Its these little disagreements and conflicts that tarnish that potential, and create problems within the park.

^ If the property is his road the city can use the law placed into effect last year where a city can force someone to sell their land for a reasonable sum if the new use will bring in more tax $'s. The amusement park will bring in more $ than his own personal land...

This is really stupid. Why argue over 700ft of road. What is he going to do with the land if it's road. turn around and sell it to he county to be a road again. Also the lose f business an organizations canceling events is a bad move. Why punish the park over something they didn't start.

If it is his private road and somebody gets in an accident, or possibly dies, on it, he could be held liable since it is his road (I think thats how it works)

If that was the case, I'd certaintly not want to be held liable and would want to sell it to the park and drag strip pronto.

This reminds me way too much of the neighbors that complained about one of the UK parks (can't recall which), but the neighbors moaned and groaned about the noise from the park.

I have a solution...move!

This guy really should just sell the land (if its his to begin with it).

It really sounds though like its county land (or soon will be). lol

Also, the original article didn't say but I'm thinking this really affects the drag strip more than the park itself. Although if they had to move access to the drag strip through the park section it would be a mess.

I believe you're taling about Alton Towers.
In that case it really depends who was there first. If the park was there before the people started moving in then they have no right to complain because they should've known what they were getting into. But, if the park came after the people moved it, then if there is excessive noise, the people could complain.
