News: Disney whiplash suit thrown out

Mar. 1st, 2004 -- David Heber claimed he was jolted by a ride on Disney's California Adventure's California Screamin' in August 2001.

Heber, a surgeon from Milwaukee, said the roller coaster restraint was improperly maintained and did not hold him in properly.

Heber filed suit for $10 million in June 2002.

Heber's attorney tried to make a connection between his injury claim and the accident on Big Thunder Mountain Railroad that killed Marcelo Torres in September.

Jurors deliberated for just over two hours before voting unanimously to deny the claim.

Disneyland is "pleased the jury found in (their) favor," spokeswoman Sondra Haley said.

YES! Finally a smart jury. This guy was a total moron to try and get a case out of this.

The dumbest thing was that he actually tried to make it sound like he knew what was going on. How the heck would he know faulty maintenance caused the restraint to behave differently?

My guess was the idiot sat in the seat wrong and didn't know how to handle turns. What a baby. I'm glad this was thrown out.

Well I'm glad SOME people have some common sense. I really hope Disney or some other company can make an example of this guy. I'm just sad that it has gotten to the point of making up stuff just for a quick buck, and while it's nothing new, it still saddens me everytime a case like this is found in favor of the plaintiff when it had very little, if any, merit to begin with.

This is a good day for Disney, us enthusiasts that know better, and for money hungry people to get a small clue. I mean, come on he was a Surgeon, what does he know about restraints and if they were "improperly maintained."

Sounds like just another person trying to "get rich quick". I'm glad the guy didn't get the loot. WTG jury!!
