Interesting. Shouldn't the lawsuit be against the manufacturer though? Hypothetically, say Cisco is continuing to sue Apple for infringment of the iPhone name. It would be Apple getting sued there, not the owners of the product. I'm not quite sure how/why this is different...?

My belief is that they targeted the theme park operators because their pockets are deeper than that of the rides' manufacturer. In addition, it generates immediate publicity by bringing big names like Disney, Anheuser Busch and NBC Universal to court over patent infringement. And keep in mind, it's not that easy to put together a lawsuit with enough incriminating evidence, let alone try and bring European firms into the picture.

What Walt Disney World rides have Magnetic brakes? Other than Everest. And Busch Gardens? This is a BS Lawsuit.

Busch Gardens has rides with magnetic brakes?? Which one is it? But like was said earlier, I agree that the company went after Busch, Disney and Universal specifically because they make a ton of money per year.

^^ I agree to an extent as well, the article never mentions how they infringed on the patent... how do you infringe on that type of patent?

Vedved82491 and Coaster_holic24 --- it's really as simple as:
Company owns exclusive license to patents for magnetic braking technology.
Company discovers multiple theme park operators have installed this technology on a bunch of their roller coasters and rides.
Company accuses of all those listed amusement park operators in a lawsuit for patent infringement (stealing technology protected by the patent).
What's not to understand?

Only in America. We come up with the stupidest things to sue over now. Do you think the parks will have to close any of the questioned rides for a period of time? I sure hope not.

Sheikra at BGA uses magnetic brakes for those wondering about Busch using them....
This seems like crap, doesn't make sense to me why they would sue the parks and not the maufacturers. Why not sue the poeple who rode the rides while you're at it? *roll eyes*

HAHA This is like a person with the patent of... lets say... a telephone button suing NOT the manafacturers of a phone that uses rip off buttons BUT everyone in america who has bought one. Safety Braking Corporation are making themselves look like idiots.

This is a rediculous lawsuit in my opinion.
Hopefully the judge will realize that and throw it out.

I wonder why they waited so long as well. companies have been making magnetic brakes on rides for years. Also different manufacturers use different parts, assemblies, as well as technology for their magnetic brakes not Safety Braking Corp's (man what a dumb name) so therefore their claims should be automatically void.

Well, that's about the dumbest thing I ever heard, kicky. The statute of limitations on patent law is something like 99 years. If you own the patent it's yours. That's like saying if you own your car for 3 years and I steal it- you have no case against me, because you had it long enough.
I don't know that we can say if this is a rediculous litigation or not. there just are not enough details mentioned. But I know if I invented something and Disney took it and made some bucks from it, I'd want my cut. AND THAT kiddies is why Safety Brake is bringing the case against the parks and not the manufacturers---the parks, while using them, are benefeiting financially from the brakes.

Kicky did not say that he thinks they don't have a case because they waited so long, he was just wondering why they waited so long.
Also, you make it sound as if the manufacturers did not make any money off of the brakes. Well, they did.
