News: Estate of man sues Six Flags New England

Posted at 1:04 PM EDT (1704 GMT)

Sep. 2nd, 2004 -- The estate and family of Stanley Mordarsky, who was killed on Superman: Ride of Steel in May, has filed a wrongful death lawsuit against Six Flags New England.

The amusement park and family have tried to settle out of court, but the $200,000 offered by Six Flags New England was not appeasing enough, even though family members claim "this isn't about the money". They are asking for at least $500,000 is damages.

The incident sparked changes to Superman: Ride of Steel and similar rides throughout the country.  The ride restraints have been modified and more attention is put on checking the size of guests to ensure their safety.

In the investigation following the incident, the Massachusetts Department of Public Safety placed blame with both the park and the rider.  The park had failed to adequately check the guest's restraint, while Mr. Mordarsky failed to tell operators he had cerebral palsy.

It's a shame this all had to happen just because a worker or two didn't do their jobs properly.
